ACTIVISM UPDATE: AOL/Time Warner Merger Approved December 15, 2000 On December 14, the Federal Trade Commission voted unanimously to approve the merger of Time Warner and America Online, creating the world's largest media company. The deal was the source of intense lobbying by citizen groups like Consumers Union and the Center for Media Education, as well as major media companies like Disney and Microsoft; FAIR activists sent hundreds of letters criticizing the merger to the FTC. In the end, some provisions of the deal were considered victories for consumers: For example, the consent decree requires that access to Time Warner's cable lines be granted to at least three other internet service providers. High-speed internet access was the issue that FAIR's January alert encouraged activists to raise with the FTC. But larger questions about media diversity remain. The FTC did little to address concerns that the media giant would engage in extensive promotion of its own content, sometimes to the exclusion of other content. As the New York Times reports (12/15/00), "Beyond high-speed Internet service, the terms announced yesterday do little to impede AOL Time Warner." A Washington Post report (12/14/00) outlined some of the policies that are already in place: "AOL users who want to check out music or television reviews are steered to Time Warner's Entertainment Weekly Web site. If they want the latest news on celebrities their mouse will take them to Time Warner's People.com. And AOL users who seek the latest developments in the presidential election will find that Time Warner's CNN.com and Time.com are prominent options." The Post also reported that one AOL executive says that the cross promotions between the companies have generated 500,000 new Time Warner magazine subscriptions in just five months. It's just the tip of the iceberg: As one industry analyst told the Post, "They have not yet begun to cross-promote." The merger certainly is a milestone in media concentration, and threatens to make the era of new media more rather than less centralized. The firm, Atlanta-based iXL Enterprises, sued to learn the name of an individual who posted comments on a Yahoo! message board about the reasons for the company's declining fortunes. After filing its lawsuit, iXL obtained a subpoena that it served to Yahoo! to learn the person's name. Public Citizen is representing the individual, identified in court papers only as John Doe. iXL's efforts violate the man's First Amendment rights, as well as his privacy rights under the Georgia Constitution, Public Citizen said in a brief filed on Monday in the Superior Court of Fulton County. "iXL is attempting to use the court as a private detective service, to locate a member of the public who has engaged in speech critical of the company" said Paul Alan Levy, an attorney for Public Citizen Litigation Group, which is representing Doe. "It's a blatant attempt not only to violate this man's rights but to intimidate other people from expressing themselves freely." In its complaint, iXL alleges that Doe is an iXL employee and that his postings violated an employment agreement. However, Doe is not an iXL employee and has produced evidence to prove it, the brief says. iXL also claims that Doe made false and derogatory statements containing confidential business information, but the company has not said what those statements were. Nor did the company say that Doe's comments damaged the company in any way. Further, company officers had adequate chance to post their own rebuttal to the man's comments, Public Citizen said. The Internet, Levy argued, is "a forum for public discourse on any subject. People have a right to participate in public debates, and that's just what these message boards are -- ongoing public debates." Doe posted a number of messages on the iXL chat site, some of which were critical of iXL or staff members. Others were complimentary, but none were "even arguably defamatory," the brief states. When Yahoo! contacted Doe to alert him to iXL's court action, Doe contacted the company's lawyer and was promised that iXL would drop its court action if Doe could prove he was not an iXL employee. Levy, of Public Citizen, followed up with the company's attorney, but he has refused to discuss the matter, claiming "the existence of other pressing business," the brief states. Doe is concerned that the lawsuit could cost him his current job if his employer were to learn about it, the brief states. Public Citizen filed the brief because it champions free speech rights. The non-profit consumer advocacy organization has defended the right of anonymity in several similar suits, including one filed by Thomas & Betts Corporation, a Tennessee manufacturer of electrical components, and another filed by Dendrite International, a New Jersey supplier of sales force software products and support services for the pharmaceutical industry. The Tennessee company dismissed the case with a statement that it did not want to chill free speech on the Internet. In the New Jersey case, a court in November rejected the company's attempt to discover the identities of the anonymous Internet message posters, saying the company had failed to meet the stringent legal standards required for them to obtain those names. Also representing Doe in the current case are Jeffrey D. Sodko and Robert S. Before this crime occurred we had planned on raising $50,000 for the Luna Preservation Endowment to monitor the tree in perpetuity. Now more than ever, funds need to be raised to protect the tree and all that she stands for. On the legal front Sanctuary Forest has hired an independent criminal investigator to find the perpetrator of this hate crime against nature. A private detective is being hired to facilitate a thorough investigation. The costs of immediate treatment for the tree, a legal investigation, and ongoing monitoring efforts will likely exceed the $50,000 endowment that we initially envisioned. CHAIN SAWS TO RIP SPOTTED OWL HABITAT The BLM in Oregon has given the go ahead to log ancient forests where "at least one pair--and as many as three pairs--of northern spotted owls nest" says AP 12/5. Under the Northwest Forest Plan even trees where the owls nest can be logged as long as it is not done in the summer when they are raising their young. Such logging still makes the trees "unavailable to owls in future years, when the birds often return to familiar trees or stands." Environmentalists contend that the logging exposes the plan's flaws: as options for supplying commercial timber run out, the agency can begin to offer timber sales in "matrix lands" that are actually occupied by the owls. ENDANGERED SALMON UPDATE - ACTION NEEDED NOW! President Clinton has only a few weeks left to decide whether to save wild Snake River salmon or allow them to become extinct, turning them into museum artifacts. LARGEST PRIVATE COMMERCIAL SOLAR SYSTEM IN WESTERN HEMISPHERE The largest private commercial solar power system in the Western Hemisphere was dedicated last week in California. The solar installation involves almost one acre of advanced solar photovoltaic (PV) panels on the roof of the three story City Center office building in Fountain Valley and on the roof of the Carlsbad Pointe industrial building in Orange County. The Fountain Valley building is owned by Arden Realty of Los Angeles. Dan Cashdan, chairman of RealEnergy Corp. of Los Angeles, commented "Distributed generation systems offering reliable, high quality, economical energy, are an extremely attractive hedge against a repeat of the near disasters of last summer. And they're a clean source, offsetting the creation of tons of toxins produced by old central power plants." "Given the brownouts in San Diego, San Francisco, Chicago and elsewhere last summer, buildings with reliable power will increasingly be seen as premium, preferred locations," explains Richard Ziman, chairman and CEO of Arden Realty, the largest commercial real estate landlord in Southern California. "Distributed generation supports the environment and our tenants. Companies dependent on their computer systems or who have global 24/7 operations increasingly are recognizing they are at risk to a serious or even fatal business interruption tied to poor quality power." "Although solar electricity costs roughly 15 cents per kilowatt hour delivered versus traditional regulated power ranging from three to 12 cents under tariff, solar competes on a time of use basis with peak demand, peak price kilowatts on any given day," says Paul Slye, president of RealEnergy. "Many property owners and operators appreciate the risk management tool that solar represents." "Peak period grid delivered power costs 19 cents per kWh in certain municipalities, and runs as high as 27 or more in investor owned utility service territories," he notes. "Fixing the all in cost for power with solar at 15 cents per kWh can help stabilize budgets and effectively cap energy outlays. This feature is gaining value in regions outside of San Diego as more utilities abandon old tariff rate schedules and customers are exposed to the real price of power." The Fountain Valley and Carlsbad systems, which generate approximately 545,500 kWh annually, will offset the burning of 41,300 barrels of oil, or 12,000 tons coal, or 2600 million cubic feet of natural gas over the first 30 years than traditional fossil fuel power sources. That also means sparing the air with 9,300 fewer tons of harmful cumulative emissions. U.S. GOVERNMENT DEMONSTRATES COMMITMENT TO RENEWABLES A 2,800-panel, 100 kW multi-celled thin-film PV system is now installed at the U.S. General Services Administration's Suitland, Maryland Federal Center. Through the Million Solar Roofs initiative over 100,000 solar roofs have been installed since 1997 - nearly double the goal of 51,000 solar roofs by 2000. The federal government also exceeded the goal set forth in President Clinton's Executive Order 13123, which requires 2,000 solar energy systems be installed on federal buildings by the end of 2000. 2,100 systems are operational now - the government plans to meets its goal of 20,000 PV system installations by 2010. In early 2002, the U.S. EPA's Environmental Science Center - the federal government's principal environmental laboratory - at Fort Meade, Maryland will be powered by the most efficient on-site power plant in the world. The fuel cell-gas turbine hybrid power system will be built by the Siemens-Westinghouse Power Corporation. Says U.S. DOE Secretary Richardson, "The Fort Meade project will preview a future of 'good neighbor' power generators that can be sited at or near the customer." 12/15/00 SOLAR IS BREAKING OUT ALL OVER... Siemens Solar Ships 200 Megawatts of Photovoltaics Worldwide in 2000 Siemens Solar in 2000 has shipped solar cells and solar modules with a cumulative peak power of 200 megawatts. Siemens Solar has been producing solar cells and solar modules for more than 20 years, reaching the 100 megawatts milestone in 1996 and was able to double this figure in just four years. Examples of power stations are the Mont Soleil project in Switzerland and Kerman in California, each with an output of 500 kilowatts, and the one-megawatt installation at the New Munich Trade Fair Center. With a module surface area of around 7,800 square meters, this is the largest rooftop solar power plant in the world. The cumulative figure for solar cells and modules supplied to date by Siemens Solar is equivalent to 200 times the output of this reference installation. Approximately 200 megawatts would be sufficient to supply light, water and refrigerated vaccines to over 10 million people in remote off-grid areas of developing countries. In Japan and Germany, in particular, incentive schemes for renewable energies are speeding up growth in the photovoltaics sector. The current development of the world market is also prompting Siemens Solar to invest large sums in expanding its existing production facilities. Compared to last year, the company has increased month production by around 50%. Monthly production currently stands at some 3 megawatts. If the market continues to grow at its current pace, production will have to double every three or four years to enable market participants to retain their shares. 12/15/00 An Easy To Read Analysis Of The Supreme Court Decision By Mark Levine <MarkLevine@aol.com> Q: I'm not a lawyer and I don't understand the recent Supreme Court decision in Bush v. Gore. Can you explain it to me? A: Sure. I'm a lawyer. I read it. It says Bush wins, even if Gore got the most votes. Q: But wait a second. The US Supreme Court has to give a reason, right? A: Right. Q: So Bush wins because hand-counts are illegal? A: Oh no. Six of the justices (two-thirds majority) believed the hand-counts were legal and should be done. Q: Oh. So the justices did not believe that the hand-counts would find any legal ballots? A. Nope. The five conservative justices clearly held (and all nine justices agreed) "that punch card balloting machines can produce an unfortunate number of ballots which are not punched in a clean, complete way by the voter." So there are legal votes that should be counted but can't be. Q: Oh. Does this have something to do with states' rights? Don't conservatives love that? A: Generally yes. These five justices have held that the federal government has no business telling a sovereign state university it can't steal trade secrets just because such stealing is prohibited by law. Nor does the federal government have any business telling a state that it should bar guns in schools. Nor can the federal government use the equal protection clause to force states to take measures to stop violence against women. Q: Is there an exception in this case? A: Yes, the Gore exception. States have no rights to have their own state elections when it can result in Gore being elected President. This decision is limited to only this situation. Q: C'mon. The Supremes didn't really say that. You're exaggerating. A: Nope. They held "Our consideration is limited to the present circumstances, or the problem of equal protection in election processes generally presents many complexities." Q: What complexities? A: They don't say. Q: I'll bet I know the reason. I heard Jim Baker say this. The votes can't be counted because the Florida Supreme Court "changed the rules of the election after it was held." Right? A. Dead wrong. The US Supreme Court made clear that the Florida Supreme Court did not change the rules of the election. But the US Supreme Court found the failure of the Florida Court to change the rules was wrong. Q: Huh? A: The Legislature declared that the only legal standard for counting vote is "clear intent of the voter." The Florida Court was condemned for not adopting a clearer standard. Q: I thought the Florida Court was not allowed to change the Legislature's law after the election. A: Right. Q: So what's the problem? A: They should have. The US Supreme Court said the Florida Supreme Court should have "adopt[ed] adequate statewide standards for determining what is a legal vote" Q: I thought only the Legislature could "adopt" new law. A: Right. Q: So if the Court had adopted new standards, I thought it would have been overturned. A: Right. You're catching on. Q: If the Court had adopted new standards, it would have been overturned for changing the rules. And if it didn't, it's overturned for not changing the rules. That means that no matter what the Florida Supreme Court did, legal votes could never be counted. A: Right. Next question. Q: Wait, wait. I thought the problem was "equal protection," that some counties counted votes differently from others. Isn't that a problem? A: It sure is. Across the nation, we vote in a hodgepodge of systems. Some, like the optical-scanners in largely Republican-leaning counties record 99.7% of the votes. Some, like the punchcard systems in largely Democratic-leaning counties record only 97% of the votes. So approximately 3% of Democratic votes are thrown in the trash can. Q: Aha! That's a severe equal-protection problem!!! A: No it's not. The Supreme Court wasn't worried about the 3% of Democratic ballots thrown in the trashcan in Florida. That "complexity" was not a problem. Q: Was it the butterfly ballots that violated Florida law and tricked more than 20,000 Democrats to vote for Buchanan or Gore and Buchanan. A: Nope. The Supreme Court has no problem believing that Buchanan got his highest, best support in a precinct consisting of a Jewish old age home with Holocaust survivors, who apparently have changed their mind about Hitler. Q: Yikes. So what was the serious equal protection problem? A: The problem was neither the butterfly ballot nor the 3% of Democrats (largely African-American) disenfranchised. The problem is that somewhat less than .005% of the ballots may have been determined under slightly different standards because judges sworn to uphold the law and doing their best to accomplish the legislative mandate of "clear intent of the voter" may have a slightly opinion about the voter's intent. Q: Hmmm. OK, so if those votes are thrown out, you can still count the votes where everyone agrees the voter's intent is clear? A: Nope. Q: Why not? A: No time. Q: No time to count legal votes where everyone, even Republicans, agree the intent is clear? Why not? A: Because December 12 was yesterday. Q: Is December 12 a deadline for counting votes? A: No. January 6 is the deadline. In 1960, Hawaii's votes weren't counted until January 4. Q: So why is December 12 important? A: December 12 is a deadline by which Congress can't challenge the results. Q: What does the Congressional role have to do with the Supreme Court? A: Nothing. Q: But I thought --- A: The Florida Supreme Court had earlier held it would like to complete its work by December 12 to make things easier for Congress. The United States Supreme Court is trying to help the Florida Supreme Court out by forcing the Florida court to abide by a deadline that everyone agrees is not binding. Q: But I thought the Florida Court was going to just barely have the votes counted by December 12. A: They would have made it, but the five conservative justices stopped the recount last Saturday. Q: Why? A: Justice Scalia said some of the counts may not be legal. Q: So why not separate the votes into piles, indentations for Gore, hanging chads for Bush, votes that everyone agrees went to one candidate or the other so that we know exactly how Florida voted before determining who won? Then, if some ballots (say, indentations) have to be thrown out, the American people will know right away who won Florida. A. Great idea! The US Supreme Court rejected it. They held that such counts would likely to produce election results showing Gore won and Gore's winning would cause "public acceptance" and that would "cast a cloud" over Bush's "legitimacy" that would harm "democratic stability." Q: In other words, if America knows the truth that Gore won, they won't accept the US Supreme Court overturning Gore's victory? A: Yes. Q: Is that a legal reason to stop recounts? Or a political one? A: Let's just say in all of American history and all of American law, this reason has no basis in law. But that doesn't stop the five conservatives from creating new law out of thin air. Q: Aren't these conservative justices againstjudicial activism? A: Yes, when liberal judges are perceived to have done it. Q: Well, if the December 12 deadline is not binding, why not count the votes? A: The US Supreme Court, after admitting the December 12 deadline is not binding, set December 12 as a binding deadline at 10 p.m. on December 12. 12/15/00 Q: Didn't the US Supreme Court condemn the Florida Supreme Court for arbitrarily setting a deadline? A: Yes. Q: But, but -- A: Not to worry. The US Supreme Court does not have to follow laws it sets for other courts. Q: So who caused Florida to miss the December 12 deadline? A: The Bush lawyers who first went to court to stop the recount, the rent-a-mob in Miami that got paid Florida vacations for intimidating officials, and the US Supreme Court for stopping the recount Q: So who is punished for this behavior? A: Gore, of course. Q: Tell me this Florida's laws are unconstitutional? A: Yes Q: And the laws of 50 states that allow votes to be cast or counted differently are unconstitutional? A: Yes. And 33 states have the "clear intent of the voter" standard that the US Supreme Court found was illegal in Florida. Q: Then why aren't the results of 33 states thrown out? A: Um. Because um ...the Supreme Court doesn't say. Q: But if Florida's certification includes counts expressly declared by the US Supreme Court to be unconstitutional, we don't know who really won the election there, right? A: Right. Though a careful analysis by the Miami Herald shows Gore won Florida by about 20,000 votes (excluding the butterfly ballot errors) Q: So, what do we do, have a re-vote? throw out the entire state? count under a single uniform standard? A: No. We just don't count the votes that favor Gore. Q: That's completely bizarre! That sounds like rank political favoritism! Did the justices have any financial interest in the case? A: Scalia's two sons are both lawyers working for Bush. Thomas's wife is collecting applications for people who want to work in the Bush administration. Q: Why didn't they recuse themselves? A: If either had recused himself, the vote would be 4-4, and the Florida Supreme Court decision allowing recounts would have been affirmed. Q: So what will happen to the Supreme Court when Bush becomes President. A: He will appoint more justices in the mode of Thomas and Scalia to ensure that the will of the people is less and less respected. Soon lawless ustices may constitute 6-3 or even 7-2 on the court. Q: Is there any way to stop this? A: YES. No federal judge can be confirmed without a vote in the Senate. It takes 60 votes to break a filibuster. If only 41 of the 50 Democratic Senators stand up to Bush and his Supremes and say that they will not approve a single judge appointed by him until a President can be democratically elected in 2004, the judicial reign of terror can end and one day we can hope to return to the rule of law. Q: What do I do now? A: Email this to everyone you know, and write or call your senator, reminding him that Gore beat Bush by several hundred thousand votes (three times Kennedy's margin over Nixon) and that you believe that VOTERS rather than JUDGES should determine who wins an election by counting every vote. While some segments of society will always be reluctant to examine controversial issues such as weather modification, the tremendous military capabilities that could result from this field are ignored at our own peril. From enhancing friendly operations or disrupting those of the enemy via small-scale tailoring of natural weather patterns, to complete dominance of global communications and counter-space control, weather modification offers the warfighter a wide range of possible options to defeat or coerce an adversary. Technology advancements in five major areas are necessary for an integrated weather modification capability: (1) advanced nonlinear modeling techniques, (2) computational capability, (3) information gathering and transmission, (4) a global sensor array, and (5) weather intervention techniques. Some intervention tools exist today and others may be developed and refined in the future. Current technologies which will mature over the next thirty years will offer anyone who has the necessary resources the ability to modify weather patterns and their corresponding effects, at least on the local scale. Current demographic, economic, and environmental trends will create global stresses that provide the impetus necessary for many countries or groups to turn this weather modification ability into a capability. In the US, weather modification will likely become a part of national security policy with both domestic and international applications. Our government will pursue such a policy, depending on its interests, at various levels. These levels could include: unilateral actions, participation in a security framework such as NATO, membership in an international organization such as the UN, or participation in a coalition. Assuming that in 2025 our national security strategy includes weather modification, its use in our national military strategy will naturally follow. Besides the significant benefits an operational capability would provide, another motivation to pursue weather modification is to deter and counter potential adversaries. REAL AMERICAN LAW IS ON THE VOTER'S SIDE By Margie Burns Sadly, an unfair tactic of delaying and preventing the hand recount of disputed ballots in Florida seems to have been upheld, or at least not prevented, by the courts. This loss must not obscure the way the public has been bamboozled about American election law, in this whole process, by bogus pseudo-legal arguments relentlessly reprinted in newspapers and aired on television. The over-all trend of American election law, throughout American history, has been to side with the voter, including the voter who makes a mistake. While this trend in American legal history has been conspicuously absent from commentary by George Will and Charles Krauthammer, and of course by GOP politicians, it is found clearly stated in the Corpus Juris Secundum, the fundamental encyclopedia of American law. Even to a non-lawyer, the numerous pages of Vol 29 of the C.J.S. make this central principle clear: the law is usually on the side of the voter, including the voter who makes a mistake. The principle that the voter's intent is paramount, in counting votes, is restated at least ten times, with scores of legal cases as examples. The section of the C.J.S. on recounts extends a further twenty pages, with further scores of legal cases. Here follow some examples of the clear restatement of this principle, so obviously more appropriate to the country we know and love than the rigid hysteria insisting on throwing out every vote possible: "While there must be a compliance with statutory provisions, the voter may not be disfranchised where he made an honest, although partly unsuccessful, effort at compliance, and, in general, HIS INTENT will be given prime consideration." Spiritual practice has as much to do with the wisdom of knowing what NOT to do, and what NOT to participate in, as it does basic precepts. Clearly, wisdom shows us that to exercise our spiritual responsibility, we must not follow the ways of destruction and corruption which are rampant in modern politics. This means that it is necessary to reject modern society and leave it utterly. Get out of debt! Dont buy all that nonsense that living is about being a "consumer" and a worker ant! Get out now while you still can! Only from a position of detachment can we offer real aid to the mass insanity of consumerism. Why focus on these things you ask? Because this is the practical necessity. To know about something or to focus upon it, does not imply giving that thing "more energy". On the contrary, our clear perception of the global situation and the reasons for its demise, (ie materialistic values) are a large part of what directly dismantles the modern illusions of government and the marketplace. In this way, we are also personally freed of the ideological chains of so called "success" as defined by the modern world. It's all just nonsense, so don't participate! By understanding that lifestyles and values are what promote society, then we understand what mistakes should be avoided in the future. This in fact is the whole value of a study of history as well... we learn from our collective mistakes, just as we can learn from personal ones. To avoid these social problems by pretending they dont exist or are irrelevant is like getting a thorn in your foot and just ignoring its presence. With lots of Love & Light to all Lifecoach@phc.igs.net 12/14/00 Dec. 14, 2000 Yucca Mountain Site Characterization Process Lacks Integrity Statement of Lisa Gue, Policy Analyst, Public Citizen's Critical Mass Energy and Environment Program, to the National Academy of Sciences Board on Radioactive Waste Management We are greatly disturbed by the manner in which the U.S. Department of Energy (DOE) is assessing the suitability of Yucca Mountain, in Nevada, for a high-level nuclear waste repository. A memo has come to light showing that the agency -- which is responsible for making and executing energy policies that are in the public interest -- is in fact going out of its way to help the nuclear industry dump its waste at the site of its choosing. This lack of impartiality by a government agency is highly improper, and we urge the board to exert as much pressure as it can to stop it. The DOE is preparing to recommend Yucca Mountain, located 90 miles northwest of Las Vegas, Nev., as a permanent disposal site for radioactive waste generated by atomic weapons facilities and commercial nuclear reactors across the country. If the proposal is approved, 70,000 metric tons of high-level nuclear waste will be transported through 43 states for burial in Nevada. Currently, the agency is assessing the suitability of Yucca Mountain for the repository. The agency is required to maintain impartiality during this process and withstand pressure from the nuclear industry, which sees the repository as a convenient way to get rid of its waste and transfer liability for it to the government. A document recently discussed in a Las Vegas Sun article clearly points to DOE bias in favor of the industry. The document -- a memo attached to an overview of a DOE report -- indicates that the overview is designed to help industry lobbyists win support for the Yucca Mountain proposal in Congress. This "smoking gun" evidence of industry bias within the DOE is extremely discouraging to members of the public who have participated in good faith in the various hearings and comment periods required by the Nuclear Waste Policy Act. It now appears that public participation has been solicited merely to lend legitimacy to a process in which the selection of Yucca Mountain is a foregone conclusion. The memo isn't the only thing indicating that the selection of Yucca Mountain is fast becoming a done deal. The Nuclear Regulatory Commission (NRC) and DOE have been trying to resolve so-called "key technical issues" to obtain a license for a Yucca Mountain repository, even though the DOE has not received the necessary congressional approval to apply for a license. In a similarly inappropriate display of premature confidence, the overview report written about by the Sun outlines the basis for a DOE recommendation of the Yucca Mountain repository. Yet many steps are to be taken before the DOE embarks on this phase of the selection process. For instance, DOE's recommendation is supposed to be contingent on regulations that have not been finalized -- most notably proposed changes to DOE site suitability guidelines and the U.S. Environmental Protection Agency's radiation protection standards. Likewise, environmental impact statement for Yucca Mountain is not scheduled to be issued until late next spring. Further proof that the government intends to approve the Yucca Mountain site lies in a proposal by a private consortium called Private Fuel Storage to open an interim waste storage facility in Utah. In the consortium's draft environmental impact statement, the NRC explicitly assumes that waste will eventually be transferred to Yucca Mountain. In protest, Public Citizen has joined environmental and public interest groups across the country in calling for President Clinton to issue an executive order preventing the licensing of a private fuel storage facility. We urge this board to recognize these clear signs of pro-industry bias within the DOE, because they seriously undermine the integrity of the Yucca Mountain site characterization process. In light of this board's advisory role to Congress, we urge board members to press for closer oversight of DOE. The public cannot be expected to have confidence in a process conducted by an agency that so obviously fails to maintain impartiality. 12/14/00 Real democracy comes from waking up By Howard Zinn and Gary Krane The political culture of the United States is obsessed with and dominated by voting. Every election year is accompanied by the media's and the politicians' obsession with persuading Americans that voting for one candidate or another (and only if they are Democrat or Republican, of course) is the most important act of citizenship. We get high on voting and forget that whether presidents have been Republican or Democrat, impotent or oversexed, they have followed the same basic policies. Whether crooks or Boy Scouts, handsome or homely, agile or clumsy, they have taxed the poor; subsidized the rich; squandered the nation's commonwealth (our minerals, airwaves, water and forests); wasted our taxes on bombers, missiles, ships and other corporate welfare; ignored the decay of the cities; and done so little for poor minority kids that for every Afro-American in college, five are now in prison, and for every Latino in college, three are in prison. Harry Truman was blunt, and Lyndon Johnson and Richard Nixon were wily. And Jimmy Carter, Ronald Reagan and Bill Clinton were charming. But the first three spent billions and sent armies to Asia to defend dictators and massacre more than 2 million of the people we claimed to be helping, and the latter three again spent billions of our taxes to also arm and prop up dictators and oligarchies, and to subvert democratic movements against those governments in places like Indonesia, El Salvador and Guatemala, ending in murder of hundreds of thousands of innocent people. John F. Kennedy was witty; Carter was "caring"; George Bush, the elder, was firm; and Reagan said he was against big government. But all expanded our federal budgets enormously by spending hundreds of billions building up grotesquely huge nuclear weapons systems (we continue building B-2 bombers at $2 billion apiece) at the expense of providing a great public education system, health care for all Americans regardless of income, jobs that pay a living wage and mass transit for all of our cities. Despite the decimation of the former Soviet Union, Al Gore and George W. Bush both want to continue this military spending madness, which year after year consumes more than 50 percent of our discretionary federal budget (the budget that the president and Congress determine). And Bush has the gall to claim he is against big government. Nixon was corrupt and Gerald Ford straightforward, Reagan endearing and Clinton someone who claimed to feel the pain of the poor. But all coldly cut essential benefits for the poor and gave hundreds of billions of dollars of favors instead to rich corporations and billionaires. This obsession with voting is made all the worse by corporate media's obsession with "fine distinctions." The more the media can keep us distracted by this tweedledum-tweedledee horse race, the more they (and therefore the major candidates themselves) can avoid dealing with the huge issues and solutions being purposely ignored by both major party candidates: Issues like who in fact owns and controls both houses, universal health care, full public funding of elections, seriously cutting the defense budget, decriminalizing drugs, returning to labor their rights to organize, and the frightening concentration of media ownership itself. Why else did they both make sure Ralph Nader was kept out of the debates? The tragedy of all this is that this cult of voting and fine distinctions (and often "personality" as well) takes the energy of ordinary citizens, which, combined, can be a powerful force, and depletes it in the spectator sport of voting. Today, sadly, our most cherished moment of democratic citizenship comes when we leave the house once in four years to choose between two mediocre Anglo-Saxon males who have been trundled out by big corporate and billionaire-run political caucuses, million-dollar primaries and managed conventions for the rigged presidential debate and multiple choice test we call a "democratic" election. Presidents come and go, but the 200 top corporations keep increasing their almost complete control over our elections and the two major parties' candidates (with big corporations and billionaires funding 90 percent to 98 percent of both parties' budgets), over our work lives by weakening labor's rights, over our health care rights (43 million uninsured now compared to 32 million when Clinton took office), over our airwaves, and over our legal and court system, even determining how easily any of us can be sent to prison for victimless "crimes." To further prove greed knows no boundaries, they now want to take over public education and social security. No president in this century has stopped the trend. Not even Franklin Delano Roosevelt. Only when mass movements have galvanized the country have presidents made important reforms, as when strikes and turmoil throughout the nation in the 1930s pushed FDR into his New Deal measures. Sure, Roosevelt was a sensitive man. But it took mass protests to sharpen that sensitivity and make it take action. Then and only then did he take huge steps to help the poor, establish the minimum wage and create Social Security (which had been the Socialist Party's most popular demand). But that didn't change the basic nature of an unfettered capitalist system, whose highest priority has always been profits and power and to hell with the rest. Voting Day 2000 has again come and gone. Sure, one of the presidential candidates is better than the other. But we will go a long way from spectator democracy to real democracy when we understand that the future of this country doesn't depend, mainly, on who is our next president. It depends on whether the American citizen, fed up with the buying off of our Congress and president by the billionaires; fed up with the murderous greed of our health care system and the pharmaceutical companies; fed up with the planetary self-destructive path of our energy, auto, lumber, agribusiness and chemical companies; will organize all over the country a clamor for change even greater than the labor uprisings of the '30s or the black rebellion of the '60s and shake this country out of old paths and falsehood into new paths and the truth. But researchers at the Transport Research Laboratory in Crowthorne, Berkshire, have concluded that high doses of cannabis have a bad effect on driving - but not as bad as alcohol or tiredness. The researchers found that volunteers drove more slowly and cautiously to compensate for their intoxication after taking cannabis . The team recruited 15 volunteers to undergo driving tests while under the influence of high or low doses of cannabis, or having not taken the drug at all. The participants either smoked ready-rolled "spliffs" or rolled their own with resin supplied under a Government licence, New Scientist magazine reported. They were then put through their paces on a hi-tech driving simulator. But they found it very difficult to follow a figure-of-eight loop of road when given a high dose. Steering ability was the only skill adversely affected. Reaction times to motorway hazards and performance on cognitive tests remained unchanged. Previous trials at the laboratory have shown that alcohol and tiredness have a worse effect on driving, affecting higher thinking processes. Pete Henshall, of the Legalise Cannabis Alliance, said: "Any person who is not in full control of their body should not drive, be it through tiredness, alcohol, cannabis or drugs... but everything must be seen in proportion. The ruling issued Tuesday by the US Supreme Court marks a turning point in US history. It constitutes a fundamental and irrevocable break with democracy and the traditional forms of bourgeois legality. There is no precedent for the action taken by the Court. After an election in which 100 million people voted, the result has been determined by five unelected judges in a five-to-four split decision. The majority on the Court halted the counting of votes in Florida for the transparent purpose of preventing Democratic presidential candidate Al Gore, who won the popular vote nationally, from getting credit for ballots cast in his favor and thereby winning the state's pivotal electoral votes. The judges stole the election and threw it to their Republican ally George W. Bush. They did so in broad view of the American people, overturning a decision of the Florida Supreme Court and dismissing the warnings of their fellow justices, who protested in vain that the ruling would undermine the legitimacy of the judiciary and discredit the United States' claims to represent democratic principles. One section of the decision handed down by Chief Justice William Rehnquist and associate justices Antonin Scalia, Clarence Thomas, Sandra Day O'Connor and Anthony Kennedy bears quoting. In its bald denial of the right of suffrage, it reveals the essence of their action: "The individual citizen has no federal constitutional right to vote for electors for the President of the United States unless and until the state legislature chooses a statewide election as the means to implement its power to appoint members of the Electoral College. The majority decision goes on to say that any state legislature can, at any time, revoke the popular vote for president and "if it so chooses, select the electors itself. The very methods employed by the Bush campaign and its allies on the Supreme Court, and the overtly anti-democratic basis of their actions, reveal the nature of the policies the new administration intends to carry out. Bush speaks for the most ruthless and avaricious sections of the ruling class"those who demand the removal of all legal, political and moral limitations on the exploitation of the working class, the realization of profit and the accumulation of personal wealth. The 2000 election brought to a head a bitter conflict over policy and strategy that has been raging within the US ruling elite for the past decade. A substantial section within the corporate and political establishment never accepted the legitimacy of the Democratic Clinton-Gore administration. Despite Clinton's efforts to conciliate the Republican right and adapt to its social agenda, powerful forces within financial and corporate circles saw his administration as a retreat from the aggressive anti-labor and pro-business policies of Reagan and the elder George Bush. They bitterly resented Clinton's token gestures toward social reform. These forces sought to remove Clinton from office, backing the series of scandals and provocations that culminated in the impeachment and Senate trial of the Democratic president. The Supreme Court figured prominently in that attempted coup, beginning with its unanimous ruling in May of 1997 denying Clinton's request for a postponement of the Paula Jones sexual harassment suit until after his term of office. Chief Justice Rehnquist played a key role in the conspiracy, appointing the ultra-right judge who fired the first Whitewater independent counsel and replaced him with Kenneth Starr. Having failed to bring down Clinton, these same forces have acted to hijack the 2000 election and return a Republican administration that will pursue a course of class confrontation and employ authoritarian methods. No premise of Marxism is more hotly denounced by defenders of the capitalist system, liberal and conservative alike, than the theoretical conception that the state is an instrument of class rule, and that bourgeois democracy is, in the final analysis, a form of the dictatorship of capital. Yet the working out of the electoral crisis has provided a powerful confirmation of this basic Marxist precept. Five high court judges, the most elite representatives of the American bourgeoisie, have intervened to decide the election and override the votes of 50 million Gore supporters. That the Court's action is an attack on democratic rights is acknowledged in the dissenting opinion of Associate Justice John Paul Stevens, who writes: "In the interest of finality, however, the majority effectively orders the disenfranchisement of an unknown number of voters whose ballots reveal their intent"and are therefore legal votes under state law"but were for some reason rejected by the ballot-counting machines. In concluding his bitter dissent, Stevens states: "Although we may never know with complete certainty the identity of the winner of this year's Presidential election, the identity of the loser is perfectly clear. It is the Nation's confidence in the judge as an impartial guardian of the rule of law. Here Stevens points to a significant aspect of the process that has unfolded over the past five weeks: the recklessness exhibited by the dominant factions within the US ruling elite that back the Republican Party. Their willingness to sacrifice the legitimacy of the Supreme Court in the eyes of broad sections of the public underscores the authoritarian trajectory of their policies. Public confidence in the Court is less critical to those who are breaking with democratic norms and moving in the direction of dictatorial rule. It is, however, a fact that with the discrediting of the high court, every institution of the bourgeois state has fallen into disrepute. Congress has already been disgraced in the eyes of broad masses for its role in the Monica Lewinsky sex scandal and impeachment conspiracy. The odor of fraud hangs over the presidency even before George W. Bush takes up residency in the White House. The deep-rooted social polarization within American society has now found a stark expression in the breakdown of traditional bourgeois democratic institutions. The fierce and protracted conflicts within the ruling elite have spilled over to society at large, and the masses can no longer be kept on the sidelines. The social and political attacks that will be launched by the Bush administration will meet with ever greater resistance from working people and all those prepared to fight for democratic rights and social justice. The flabby opposition of Gore and the Democrats is one thing. The opposition of the working class is something altogether different. The crisis of the 2000 election marks a new point of departure in American life, and, indeed, in world affairs. Social relations and political conditions will never return to what they were before November 7. The first task of the American working class is to work through this immense political experience, and draw the appropriate political lessons. The Socialist Equality Party and its political organ, the World Socialist Web Site, are prepared to play a leading role in this process of political education and preparation for the great class battles ahead.

Dear Secretary Richardson, The undersigned [insert number here] public interest and environmental organizations, on behalf of our combined memberships, wish to express our deep concerns about the recent revelations involving the Yucca Mountain Project. The Las Vegas Sun newspaper reported on December 1st that Ivan Itkin, the Department of Energy (DOE) Office of Civilian Radioactive Waste Management's director, acknowledged he is close to recommending Yucca Mountain as a safe site for the permanent national repository for high-level nuclear waste. "We do not see any showstoppers," Itkin is quoted as saying. The article also reported that a draft copy of an overview of the soon to be released Yucca Mountain "Site Recommendation Considerations Report" (SRCR) obtained by the Las Vegas Sun states: "The report concludes that a repository that is likely to meet the safety standards proposed by the Environmental Protection Agency and the licensing requirements of the Nuclear Regulatory Commission can be designed, constructed and operated at the Yucca Mountain site." It is very troubling that Dr. Itkin and the SRCR are making such confident assertions, when EPA standards and NRC requirements have not yet even been finalized. In November 1998, over 200 public interest and environmental organizations petitioned you to disqualify Yucca Mountain from any further consideration as a potential nuclear waste repository. The request was based on the DOE's own Guidelines for Site Suitability. Less than 50 year old rainwater found by DOE scientists at the proposed repository depth within Yucca Mountain provides compelling evidence that "pre-waste-emplacement ground-water travel time from the disturbed zone to the accessible environment is expected to be less than 1,000 years" along a pathway of likely and significant radionuclide travel. Thus, under 10 Code of Federal Regulations Part 960.4-2-1, "Post-Closure Disqualifying Condition for Hydrology," the Yucca Mountain site should be disqualified. The Nuclear Waste Policy Act gives the Secretary of Energy clear authority to terminate site characterization at Yucca Mountain at any time that the site is determined to be unsuitable. Your Department responded to the petition not by challenging the assertion that the Yucca Mountain site should be disqualified, but rather by stating that DOE simply needed more time to study the site. However, just one year later, in November, 1999, DOE proposed to change 10 CFR 960's Guidelines for Site Suitability by simply eliminating individual disqualifying conditions, such as the one for fast flow of water cited in the petition. Rather than answer the charge in the petition, DOE decided to change the rules in the middle of the game. Yet again, well over 150 public interest and environmental organizations protested DOE's actions via the public comment process, and also wrote you to urge that the proposed rule change be withdrawn. There has been no official response, but DOE has moved ahead in its Yucca Mountain Project activities behaving as if the proposed change is already a finalized rule. DOE's ever more apparent disregard for the concerns of the public interest and environmental community came into sharp focus in light of the contents of a two page DOE contractor memo attached to the SRCR draft overview obtained by the Las Vegas Sun. The memo states "The Overview provides information that potential supporters can use in expressing support for a site recommendation. It is not intended to convert those who oppose a Yucca Mountain repository or any solution to the nuclear waste problem." It goes on to state "the technical suitability of the site is less of a concern to Congress than the broader issue of whether the nuclear waste problem can be solved at an affordable price in both financial and political terms." Such statements represent an outrageous betrayal of the public trust. The DOE is supposed to serve the American people, not the nuclear power industry. It is now all too clear that DOE's impending determination that Yucca Mountain is a suitable site for a nuclear waste repository is based not on sound science and public safety, but on politics and money. Many of our organizations have faithfully taken part-every step of the way and over the course of many years--in DOE's official public participation process for the Yucca Mountain Project. We have urged you, Secretary Richardson, to disqualify the site for safety reasons. We have urged you and your Department to enforce DOE's own safety-based siting guidelines, not to do away with them. We have continuously raised questions about the site's safety, or lack thereof. DOE has proven itself disingenuous. It is abundantly clear that the soon to be released DOE Site Recommendation Considerations Report for Yucca Mountain is a document intended not to address issues of public health, safety, and the environment, but rather to help nuclear industry lobbyists "sell" Yucca Mountain on Capitol Hill. Upon release of the SRCR, DOE will yet again ask the public and our organizations to take part in hearings. But DOE seems much more concerned with what's happening in nuclear utility corporate boardrooms and the halls of power than in public hearings. These recent revelations of DOE collusion with the nuclear industry, placing money and politics over public involvement, safety, and sound science, have hammered the final nails in the coffin of the Yucca Mountain Project's credibility. Given the damage, it is hard to say what, if anything, DOE could do to restore faith in its activities at Yucca Mountain. For the reasons cited above, we urge you to exercise your clear authority under the Nuclear Waste Policy Act to disqualify the Yucca Mountain site based on its unsuitability. As a first step toward this end, DOE should withdraw its fatally flawed Draft Environmental Impact Statement. A legitimate Environmental Impact Statement would adequately address groundwater travel time, site specific transportation impacts in the 43 States that would be traversed by tens of thousands of high-level nuclear waste truck and train shipments, and the cataclysmic risks of earthquakes, volcanic eruptions, and the upwelling of superheated water that could flood the repository within Yucca Mountain, releasing massive amounts of radiation into the environment. A legitimate Environmental Impact Statement would serve as the basis for the Energy Secretary's decision to disqualify Yucca Mountain. High-level radioactive wastes are among the deadliest poisons on Earth, and remain hazardous for hundreds of thousands of years. Nuclear waste isolation from the living environment is the goal of the nuclear waste repository program. No compromise is acceptable. An unsuitable site should not be used for high-level nuclear waste disposal. If Yucca Mountain cannot meet stringent safety standards, it must be disqualified. We await your action. Last year the Swiss environmentalist flew a motorized glider over the capital city of Malaysia's state of Sarawak and then landed near the residence of the chief minister. He wanted to deliver a symbolic sacrificial lamb during a Muslim holiday. Chief Minister Taib Mahmud was not amused and his officials promptly deported the activist from Kuching. He'd already been banned from the country for his determined effort to protect the lifestyle of the Penans, who are thought to be one of the world's last nomadic rainforest tribe. Manser, 45, believes the tribe to be under threat from logging companies. He lived with the tribes people for six years, from 1984 to 1990. Over the last 15 years, through various stunts and protest efforts, he has called attention to the destruction of Borneo's ancient primary forest, and to the plight of the Penans. Manser has elicited the support of luminaries like Jerry Garcia, the late leader of the Grateful Dead band, and U.S. Vice President Al Gore. But he's also confounded Malaysian authorities and enraged local timber tycoons. Last May 22 Manser snuck into Sarawak again. As usual, he slipped across the border via the neighboring Indonesian province of Kalimantan. He returned, according to the Swiss-based Bruno Manser Fund, to visit his old tribal friends who ``are under greater threat than ever before.'` But Manser hasn't been seen since. His family is worried that something terrible has happened to him while trekking through the jungle by himself. King cobras, pythons and bears are the principal threats in the bush. Some friends fear he may have been killed by logging company goons. There have been four searches by the Penans themselves, but they've turned up nothing. Three weeks ago the Manser family asked the Malaysian government for help locating the activist. Nothing much has been done-- though when queried by a local newspaper about Manser's disappearance, a Sarawak politician blasted Malaysia's longtime antagonist. ``We don't want you here," said Senator Joseph Balan Seling to the missing Swiss man. ``Don't get in touch with the Penans. Don't influence or disrupt their lives again.'` Manser first took up the Penan cause in 1984. Soon after, the previously docile tribesmen began throwing up blockades to obstruct the Sarawak logging industry--the state's biggest industry. Hundreds camped out at the blockades, sometimes for months, demanding government recognition of native lands, and fair compensation. No one disputes the fact that widespread logging has disturbed the lifestyle of the 10,000 Penans in Sarawak, even the few hundred minority that are still completely nomadic. Most of the rest are considered semi-settled but they too live deep in the rainforest, which they still depend on to get by. Their basic diet is sago (a paste derived from palm trees), and for protein, wild game, mostly deer, bear and wild boar. As timber companies have sliced further into the Borneo interior, environmentalists say the logging is fast wiping out the Sago palm trees, pollutes rivers, scares off game, and desecrates grave sites. Government officials, many of whom own sizeable stakes in timber concessions, are not sympathetic. Malaysia has long been one of the world's largest exporters of tropical timber, and has experienced one of the fastest rates of deforestation in the world. Through his relatives, Taib Mahmud, the chief minister, is alleged to be a major player in the industry and drives a vintage Rolls Royce. Manser's sustained environmental campaign has certainly cut into logging profits but officials insist their main complaint is that his activism is misguided, slowing the transition of the Penans into normal society, where they can receive education and better health care. ``How can we have an equal society when you allow a small group of people to behave like animals in the jungle? I owe it to the Penans to get them gradually into the mainstream so that they can be like any other Sarawakian," Mahmud argues. Manser insists his nomadic friends should have a choice and experts argue the Penans are custodians of invaluable - and fast-vanishing - wisdom about the rainforest. Worried friends of Manser are split about what has happened. Some of Manser's friends fear he has met a violent death. For years there have been rumors of a $50,000 bounty on the activist's head. ``I wouldn't put it past [Chinese logging companies] to disappear Bruno,'` says a foreign anthropologist who has studied the Penan in the same area. Once inside Sarawak, say Penan sources, Manser trekked around, meeting several small bands of tribesmen. It was during a three-day trek from one nomadic group to another that he disappeared. That may have been a mistake. Even Penans rarely travel that long alone. Manser had already survived one cobra bite. Some are holding out hope that Manser has another trick up his sleeve. James Ritchie, the Kuching-based reporter who first broke the story of Manser and then wrote a book about him ['Bruno Manser: The Inside Story'], believes Manser is alive and probably preparing for his next publicity coup. But he admits this is partly wishful thinking. "If Bruno is dead there is no more Penan cause, there is no one else who is crazy enough to risk their life in the jungle, and around the world, keeping attention on this issue," he says. Then again, says Paul Sochaczewski, whose new novel, 'Redheads', spoofing conservation efforts includes a Manser-like character whose death is covered up, "there is nothing like a martyr to help the cause." POP STARS Delegates from 122 nations reached agreement yesterday on a treaty to ban or reduce the use of 12 persistent organic pollutants (POPs), chemicals such as PCBs and pesticides that have been linked to cancer, birth defects, and genetic abnormalities in humans and wildlife. The ban, which must be ratified by 50 countries to become legally binding, will require some industries to find new ways to make their products without using POPs or creating POPs as a byproduct. Twenty-five developing nations will be allowed to continue to use the pesticide DDT to combat malaria until better alternatives are found. Greenpeace and the World Wildlife Fund praised the treaty as an important first step toward ending toxic pollution. BLEACH BLANKET BINGO U.S. Commerce Secretary Norman Mineta announced four initiatives to help preserve coral reefs yesterday, after a monitoring group released a report saying that 27 percent of the world's reefs were gone and that 70 percent would be dead by 2050. Mineta's plan includes creating several "no anchoring" zones for large ships near reefs in the U.S. and moving ahead on research sponsored by the U.S. and Australia to study coral reef bleaching and the effects of global warming on reefs. The report by the Global Coral Reef Monitoring Network found that bleaching destroyed 16 percent of the world's reefs in 1998 alone. LAME DUCK TALES In its last seven weeks, the Clinton administration is preparing a raft of environmental regulations. Standards for organic food labels, new limits on sulfur in diesel fuel, and protections for almost 60 million acres of roadless national forestland will be among the high-profile regs. Other regulations will likely include limits on mercury releases from power plants and waste runoff from animal feedlots, as well as a new policy barring the federal government from contracting with companies that have violated environmental laws. Word is that the U.S. EPA is hoping next fall to crack down on emissions from a wide range of mobile sources including dirt bikes, all-terrain vehicles, pleasure boats, and industrial vehicles such as forklifts -- but who knows if such a plan would survive a George W. Bush become president, environmental groups and family farm advocates yesterday unveiled a campaign in which hotshot lawyers from 15 law firms will help them fight pollution from factory hog farms. Taking a page from the tobacco war books, environmental lawyer Robert F. Kennedy, Jr., said that the most effective way to stop corporate pollution during a lax Bush administration would be to file mass tort cases against polluters with the aim of winning huge court-ordered damage awards. The enviros' pilot case is a lawsuit filed this summer against Smithfield Foods, the nation's biggest pork producer, for creating a public nuisance by spilling billions of gallons of hog waste into North Carolina rivers. The enviros estimate it would cost $148 billion to cover the damages to 3.7 million acres of wetlands. The convention calls for the elimination of PCB's, dioxins and other chemicals intentionally used or produced in manufacturing that have become known as the "dirty dozen." They are persistent organic pollutants that dissolve slowly, travel easily and are absorbed by living organisms, including humans. The treaty, which is to be signed in May in Stockholm, has been more than two and half years in the works after negotiations were begun in June 1998 in Montreal. The meeting here was scheduled to end late Saturday, but delegates agreed to extend the conference and finally concluded their negotiations early today, said Michael Williams, a meeting spokesman. "The treaty enjoyed the broadest possible support," said John Buccini, chairman of the meeting, which was organized by the United Nations Environment Program. "People not only felt that we have a treaty, but that we have a good treaty." The treaty calls for reduction of releases of dioxins and furans - toxic byproducts of burning and industrial production - "with the goal of their continuing minimization and, where feasible, ultimate elimination." The continued use of electrical equipment containing PCB's will still be permitted until 2025 as long as the equipment does not leak. It also allows for the continued use of the industrial pesticide DDT to combat malaria until other alternatives are available. Industrialized countries have already banned several of the chemicals, but the ban will still require "some hard work on the part of all countries to apply," said James Willis, an official with the United Nations Environmental Program. Countries burning their waste in open air and some factories will have to find alternative techniques, Mr. Buccini said. "It is a possibility that this could lead to a higher cost," he said. "For example, manufacturing factories are going to have to address reduction of releases of dioxins and furans." The most contentious issues were provisions for expansion of the treaty to include other chemicals and a mechanism for industrialized nations to pay about $150 million a year to help developing countries use cleaner but costlier options. In a statement, Greenpeace welcomed the treaty as the "beginning of the end of toxic pollution." The treaty must be ratified by 50 nations before it can take effect. A new public opinion survey, commissioned by FOE and published today, reveals that 63 per cent of shoppers want supermarkets to drop GM ingredients from animal feeds. Only one in five favour supermarkets stocking products from GM-fed animals. Most of the UK's leading supermarkets look set to follow Iceland's lead. Sainsbury's, Waitrose, Marks & Spencer and Asda have all said that they are removing GM ingredients from animal feed. Consumer concern has banished GM ingredients from most of our food. But GM soya and maize is still being imported in huge quantities for use in animal feeds. Maize commonly makes up 30-50 per cent of the diet of dairy cattle. Avoiding GM animal feed would be easier if it was labelled. Since 1999, food eaten by the public has had to be labelled if it contains any GM DNA. But animal feed is exempt. However, last month the Food Standards Agency said that it wants to extend labelling to cover GM animal feed. The issue is also being considered by the EU. "Congratulations to Iceland. Once again they have taken the initiative on GM food. The public have made it perfectly clear that they do not want shops and supermarkets to rear animals on GM feed," said Friends of the Earth Real Food Campaigner, Pete Riley. Background Private Fuel Storage (PFS), a consortium of 8 commercial nuclear utilities, is preparing to transport 40,000 metric tons of high-level radioactive waste ("spent fuel") across the country to an interim storage facility in Utah. Spent fuel (high-level nuclear waste) is a waste product from nuclear power plants. It is both thermally and radioactively hot and remains dangerously radioactive for hundreds of thousands of years. There is no known way to dispose of nuclear waste; it can only be stored. Currently, most spent fuel is stored on site, near the reactors where it was generated. But the PFS utilities are running out of space on site to store their radioactive garbage, so now they want to dump it in Utah! The PFS facility would be located on the Skull Valley Goshute Reservation, approximately 45 miles west of Salt Lake City. The facility would consist of above-ground, dry-cask storage for up to 4,000 canisters of spent nuclear fuel. PFS hopes to begin shipping radioactive waste to Skull Valley as soon as 2003. The PFS facility is being proposed to temporarily store nuclear waste for a period of 20-40 years. The Draft Environmental Impact Statement presumes that the waste will then be transported (again!) to a permanent repository at Yucca Mountain Nevada. But although Yucca Mountain is now being studied as a potential nuclear waste repository, the decision on whether to open a permanent facility is still pending! Transporting high-level radioactive waste is inherently dangerous because it exposes people along transportation routes to the risk of radiation release in areas where emergency responders may not be equipped for a nuclear accident. The PFS interim storage facility would unnecessarily increase this risk by requiring waste to be transported more than once over long distances. Because the PFS proposal is a private industry initiative, it does not require the consent of Congress. But, private industry should not be permitted to transfer liability for its dangerous waste to residents of Utah and people living along potential transportation routes! Take Action! Transporting high-level nuclear waste is inherently dangerous because it exposes people along transportation routes to the risk of radiation release in areas where emergency responders may not be equipped for a nuclear accident. The PFS interim storage facility would unnecessarily increase this risk by requiring waste to be transported more than once over long distances. In addition, the draft Environmental Impact Statement for the PFS facility explicitly assumes that nuclear waste stored in Utah would eventually be moved to a permanent repository at Yucca Mountain, Nevada. This assumption, at a time when no final decision has been made about the proposed Yucca Mountain repository, puts undue pressure on and undermines the integrity of the Yucca Mountain site characterization and licensing processes. It is clearly unacceptable to allow PFS to proceed with this flawed proposal, which places the economic interests of the nuclear industry above the safety of citizens along potential transportation routes and the integrity of democratic process in setting national energy policy. President Clinton, I appreciate your strong statements in opposition to previous proposals to transport high-level radioactive waste unnecessarily to an interim storage facility. Less than two weeks after receiving glowing ratings from the NRC, the Beaver Valley Nuclear Plant was forced to declare an "unusual event" -- the lowest level of the four emergency classifications used by the NRC. For nine hours, radioactive coolant spilled onto the floor of the number 2 reactor at a rate of 12 to 20 gallons per minute, according to NRC reports. The utility was forced to wait for the nuclear reactor to cool to isolate the leak. While leaks can occur, they shouldn't rise to the level of an emergency so soon after a utility is reviewed and gets such high ratings, said Wenonah Hauter, director of Public Citizen's Critical Mass Energy and Environment Program. "The Nuclear Regulatory Commission just gave the Beaver Valley reactors the best evaluation possible, and less than two week later, the reactor is forced to declare an 'unusual event,' " Hauter said. "The NRC's new oversight process is of little value if it fails to prevent accidents that rise to the level of emergencies." The NRC's new oversight process, the result of a joint effort between the NRC and the Nuclear Energy Institute (NEI) to reduce the perceived unnecessary regulatory burden on the nuclear industry, was put in place in March. It makes it more difficult for the NRC to issue failing grades to nuclear utilities, and it gives the industry much more room to err before being cited. The NRC will review the new oversight process in March 2001. "The new NRC/NEI oversight process for nuclear reactors is exposing the public to greater risk while exposing the nuclear industry to less scrutiny," said James Riccio, senior policy analyst for Public Citizen's Critical Mass Energy and Environment Program. "NRC's oversight process is severely flawed. A nuclear reactor can have a coolant leak that results in the declaration of an emergency, yet under the new oversight process, the NRC cannot deem the reactor's performance to be unacceptable." The Scientific Advisory Panel for the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) held the meeting to consider the possible allergenic effects of StarLink corn on human health. Starlink, a variety of genetically engineered corn that has not been approved by the EPA for human consumption, was recently discovered to have contaminated corn products being sold at supermarkets around the country. Dr. Hagelin's testimony created an explosion of concern among the largely pro-genetic engineering audience at the open meeting and created a fresh wave of scientific scrutiny about the hazards of GE foods. His testimony is reprinted below, along with an editorial from the Providence Journal about his leadership in the effort to protect our food supply.
STATEMENT FOR THE FIFRA SCIENTIFIC ADVISORY PANEL OPEN MEETING ON STARLINK CORN Arlington, Virginia November 28, 2000 JOHN HAGELIN, Ph.D. Director, Institute of Science, Technology and Public Policy I speak to you as a scientist who is striving to ensure that our best scientific knowledge be applied for the solution-- and prevention--of society's problems. I am a nuclear physicist who has published extensively in superstring theory and, during the last three elections, I have been the Presidential candidate of the Natural Law Party. I want to address an issue much deeper than whether the CRY9C protein in StarLink corn is likely to be allergenic. I want to address the assumptions that underlie the entire agricultural bioengineering enterprise. I am deeply concerned that life scientists are implementing bioengineering technologies without adequately understanding the lessons we have learned from the physical sciences. One of the key revelations of modern physics is that phenomena unfold in a far less linear and predictable fashion than eighteenth and nineteenth century thinkers assumed. Today we know that there are inherent limitations on our ability to make precise predictions about the behavior of a system, especially for microscopic systems and nonlinear systems of great complexity. Numerous eminent molecular biologists recognize that DNA is a complex nonlinear system and that splicing foreign genes into the DNA of a food-yielding organism can cause unpredictable side effects that could harm the health of the human consumer. Yet, the genetic engineering of our food--and the widespread presence of genetically altered foods in American supermarkets --is based on the premise that the effects of gene-splicing are so predictable that all bioengineered foods can be presumed safe unless proven otherwise. This refusal to recognize the risks of unintended and essentially unpredictable negative side effects is just plain bad science. It is astounding that so many biologists are attempting to impose a paradigm of precise, linear, billiard-ball predictably onto the behavior of DNA, when physics has long since dislodged such a paradigm from the microscopic realm and molecular biological research increasingly confirms its inapplicability to the dynamics of genomes. Moreover, the premise of predictability is not just scientifically unsound; it is morally irresponsible. The safety of our food is being put at risk in a cavalier, if not callous, fashion, not only in disregard of scientific knowledge, but in disregard of recent technological history. Here, too, lessons should have been learned from the physical sciences. Time and again, the overhasty application of nuclear technologies led to numerous health and environmental disasters. For example, in the early days of nuclear technology, the rush to commercialize led to the sale of radium tipped wands designed to remove facial hair. Nine months later the cancers came. Similarly, the failure to comprehend the full range of risks and to proceed with prudence has led to many disasters in the nuclear power industry. In the case of genetic engineering, even greater caution is called for: a nuclear disaster only lasts 10,000 years, whereas gene pollution is forever--self-perpetuating and irreversible. The irresponsible behavior that permitted the marketing of bioengineered foods has not been limited to the scientific community, but includes the executive branch of the federal government. The FDA's internal records reveal that its own experts clearly recognized the potential for gene-splicing to induce production of unpredicted toxins and carcinogens in the resultant food. These same records reveal that these warnings were covered up by FDA political appointees operating under a White House directive to promote the biotech industry. It is unconscionable that the FDA claimed itself unaware of any information showing that bioengineered foods differ from others, when its own files are filled with such information from its scientific staff. And it is unconscionable that it permits such novel foods to be marketed based on the claim they are recognized as safe by an overwhelming consensus within the scientific community, when it knows such a consensus does not exist. The StarLink fiasco further demonstrates the shoddiness of the government's regulation, since the system failed to keep even an unapproved bioengineered crop out of our food. Indeed, the contamination was discovered not by the government, but by public interest groups. The FDA had no clue and had taken no measures to monitor. This incident also demonstrates how difficult it will be to remove a bioengineered product from our food supply if it is eventually found to be harmful and, therefore, how important it is to prevent the introduction of new ones and to phase out those currently in use. It is high time that science and the truth be respected, and that the false pretenses enabling the commercialization of bioengineered foods be acknowledged and abolished. I call upon the members of this panel to uphold sound science so that you can hold your own heads up as the facts about the hazards of bioengineered food become increasingly well known. I call upon you not only to resist the pressures to approve the pesticidal protein in StarLink Corn; I call upon you to honestly acknowledge the inherent risks of genetic engineering and to affirm that, due to these risks, neither StarLink nor any other bioengineered food can be presumed safe at the present stage of our knowledge.
THE PROVIDENCE JOURNAL Editorial November 9, 2000 ONLY HAGELIN SAW GENETIC PERIL One of the key issues that never got discussed in the presidential debates this campaign season was the most serious one facing us today. The fact is that our democracy has been stolen by the powerful lobbies of the special interests. The most conclusive and blatant example of this has been the dangerous experiment being conducted by the biotech industry on the American people. They have genetically manipulated our food supply so that 60 percent of the food on our supermarket shelves has been genetically engineered. The most outrageous thing is that they did it without the knowledge or consent of the American people. Forty years ago, most scientists thought DDT a safe and promising addition to agriculture. Thalidomide was given to pregnant women by their doctors. Nuclear power was touted as the cleanest energy source on Earth. Marketed prematurely, each of these technological innovations brought unforeseen, unwanted and tragic consequences that could have been easily avoided through proper long-term safety testing. Haven't we learned anything from our mistakes? From soil to superviruses: In 1994, a genetically engineered bacterium developed to aid in the production of ethanol produced residues that rendered the land infertile. New crops planted on this soil grew three inches tall and fell over dead. The food chain: In 1996, scientists discovered that ladybugs that had eaten the aphids that had eaten genetically engineered potatoes died. The immune system: In 1998, research by Dr. Arpad Pusztai uncovered the potential for genetically altered DNA to weaken the immune system and stunt the growth of baby rats. Monarch butterflies: In May 1999, researchers at Cornell University discovered that monarch butterflies died unexpectedly from eating milkweed plants that had been dusted with the pollen of genetically engineered Bt corn. Pregnant mice: A 1998 study showed that DNA from the food fed to pregnant mice ended up in their intestinal lining, white blood cells, brain cells,and their fetuses. This suggests that the genetically engineered DNA in the food we eat can end up in our own cells. Honeybees: Last May, a leading European zoologist found the genes from genetically engineered canola jumped the species barrier and were picked up by the bacteria in the digestive tracts of bees. This indicates that antibiotic-resistant genes in genetically engineered foods can cause the bacteria in our own intestines to mutate into superbugs that cannot be killed by antibiotics. Superviruses: Viral promoters are invasive agents used by genetic engineers to trick a cell into accepting and integrating an alien gene into the cell's own DNA. Some scientists predict that releasing viral promoters into the gene pool could lead to the creation of superviruses and novel infectious diseases for organisms at every level of life--from bacteria to humans. These are just some of the dangers that are discernible in the premature marketing of genetically engineered products. The biotech industry is eager to point to their so-called successes while keeping their failures under raps. Next is the story of rBGH, recombinant bovine growth hormone (or the story of genetically engineered milk). A Monsanto lawyer drafted a letter to the FDA to get rBGH approved. He then stepped down from Monsanto and took an appointment as FDA deputy commissioner for policy. He then opened his own letter and helped draft the FDA's 1992 policy on genetically engineered food and rBGH. The law that followed, in true violation of First Amendment rights, states that it's illegal to say rBGH is in milk and it's illegal to state that it's not in milk. The lawyer returned to corporate life and became Monsanto's vice president for public policy. Incidentally, rBGH is banned in Canada, Europe, Australia, and New Zealand--all major dairy producers. It is also banned in other countries. I quote Neal D. Barnard, M.D., president of the Physicians Committee for Responsible Medicine, from a magazine entitled Safe Food News (to get this magazine and to sign the national Genetically Engineered Food Alert petition, call 1-800-REAL-FOOD). "Monsanto's rBGH increases milk production. It also increases udder infections (mastitis) and reproductive problems in cows and shortens their life span. To treat the mastitis, farmers have to give their cows antibiotics. Studies have shown that milk from rBGH cows often contains residues from those antibiotics. And because rBGH-induced mastitis leads to increased amounts of white blood cells--or pus--this is also secreted into rBGH milk. But the risks of rBGH go far beyond even this. More troublesome is the fact that rBGH has been linked to increased risk of breast, prostate and colon cancers." >From pizza to chips, soda to infant formula, ice cream to cookies, vitamins to candies, genetically engineered organisms are in the foods we feed our kids every day. Virtually every food you can think of is in the genetically engineered pipeline. And coming soon . . . rat genes in your lettuce, cows that make human milk, and bananas with vaccines. The only presidential candidate who brought this issue to the forefront of his campaign and informed the American people of the hazards of genetically engineered foods has been the quantum physicist John Hagelin of the Natural Law/Independent Party. As he traveled the country during the campaign speaking in public forums, he talked frankly about the long-term consequences of such experimentation, asking the question: "Who gave the biotech companies the right to threaten our food and environment? The Clinton-Gore administration and our 'Republicrat' Congress, awash in biotech money. We need mandatory labeling and safety testing of genetically engineered foods, plus a moratorium on the release of these experimental lifeforms into the environment until proven safe." John Hagelin's message is urgent and of utmost importance. It is essential that the American people act without delay to preserve their own health and that of future generations.

Every year about this time, quite a few people write me and ask, "My Doctor tells me to get my annual flu shot. Should I do it?" Well, I don't diagnose or prescribe, and what you do with your body remains entirely up to you and your doctor (if you still go to a doctor), but I'll gladly tell you what I do regarding flu shots... I avoid them like the plague. In fact, at age 52, I've never had a flu shot, and it would take a Marine nurse and at least four burly wrestlers the size of Jessie Ventura to hold me down and give me one. Perhaps you already sense I have strong feelings about flu shots? These feelings stem from personal opinion, reading, and dramatic personal experience. First off, I don't think toxic chemicals and virus strains grown on living tissue belong in the human body, even when they're packaged in sterile glass vials. Since my family and I don't rely on doctors anymore, I don't have access to an insert that reveals the composition of this year's flu vaccine, but I did find some general information at the Concerned Parents for Vaccine Safety <http://home.sprynet.com/%7Egyrene/> web site, where I learned about some of the ingredients used to make vaccines. Do you want any of the following vaccine constituents in YOUR bloodstream? * Ethylene glycol (antifreeze) * Phenol, also known as carbolic acid (this is used as a disinfectant, dye) * Formaldehyde, a known cancer-causing agent * Aluminum, which is associated with Alzheimer's disease and seizures and also cancer producing in laboratory mice (it is used as an additive to promote antibody response) * Thimerosal (a mercury disinfectant/preservative) can result in brain injury and autoimmune disease * Neomycin and Streptomycin (used as antibiotics) have caused allergic reaction in some people. Vaccines are also grown and strained through animal or human tissue like monkey kidney tissue, chicken embryo, embryonic guinea pig cells, calf serum, and human diploid cells (the dissected organs of aborted human fetuses as in the case of rubella, hepatitis A, and chickenpox vaccines). Well, I refuse to put all of the above in my body, and I hope when your doctor starts telling you it's time for your annual flu shot that you'll require him to defend the annual injection. You or your insurance company's probably paying eighty bucks for a visit, so get your money's worth. Have your doctor read you the insert that comes with the vaccine. Then have him/her explain why it makes sense to inject toxic chemicals into the human body and how such substances can aid the delicate immune system. Chances are he/she will fall back on questionable statistical and demographic explanations that the medical establishment has used for decades to justify immunization. Try to engage your doctor in a non-confrontational discussion because this is an opportunity for him/her to actually give some serious thought to what he/she is injecting into bodies of patients day after day after day. Many traditional doctors who haven't studied diet and lifestyle aren't going to change unless we help to educate them to what drugs and vaccines may really be doing long-term to people. Okay, to speak from personal experience for a moment, let's look over our shoulders to 1990, a time period before the Day family turned to natural methods of building health. In February of 1990, right after my wife's major cancer surgery in January, her doctor recommended a flu shot. Almost immediately after the injection, my wife started feeling ill. Overnight she came down with the worst case of flu she'd ever had. She went to bed and literally didn't get up again for more than a few hours at a time for years afterwards. Only now, almost a decade later, is she finally regaining full health and energy. Okay, I'm a realist so if I was still thinking traditionally, part of me would almost buy into the typical rationale for flu vaccines, that so many people are spared the annual flu and only a few die or have their lives ruined after being injected. I'd buy into that if I were convinced that injecting a filthy substance into the body actually made sense. Unfortunately, once I stopped buying into the big medical lies about their drug, cut, and burn system, I started questioning all of it. And when one digs into the vaccine history (check out the Swine Flu vaccine if you want a real horror story) and scientific research (especially in Europe), it quickly becomes apparent that nobody really knows what these toxic stews of chemicals and microorganisms do in the human body. Well, readers and a few medical professionals have called me a simple-minded dolt on more than one occasion, but since 1993 I've approached the yearly flu shot hype with the understanding that if I eat and live properly, I won't have to worry about catching the flu. The flu vaccine I use -- eating and living as close to nature as I can -- actually works. Not only that, but it doesn't cost a dime, and nobody's going to have his/her life ruined because of a "bad batch" of vaccine that triggers some mysterious autoimmune disease that lays a person out of commission for years. But let's say you don't want to eat and live close to nature. Okay, I can understand that, but my next question would be "Which is better? Some rest time with the flu or having toxic chemicals injected into your bloodstream?" I mean, seriously, before I got healthy I almost looked forward to a yearly bout with influenza because it meant I could go to bed and get some rest instead of working practically every waking moment of my life. I might add that I haven't missed more than two consecutive days of work from an illness for almost five years, so a non-vaccine approach does work for me. This non-drug approach has resulted in a level of health that continually amazes me, especially when I see other men and women my age who are miserable and without energy. Men and women who spend all too much of their time drifting from doctor to doctor in endless pursuit of solutions that don't get to the cause of their problems -- diet and life style. 12/11/00 LEAP, FROGS Federal scientists have found that commonly used pesticides in California's Central Valley are contributing to the decline of frogs in the state. The research found that the pesticides diazinon and Dursban are blown east into Yosemite National Park and elsewhere in the Sierra Nevada mountains, where they are absorbed in the frogs' bodies. The chemicals disrupt the nervous systems of the amphibians, perhaps causing them to die of respiratory failure. Amphibian populations are plummeting around the world and scientists agree that it is likely that there is more than one reason for the decline. San Jose Mecury News, Lisa M. After two days of talks in Ottawa, a U.S.-led bloc of nations and the European Union yesterday failed to iron out disagreements over how to implement a climate change treaty. Negotiators had hoped to reach an agreement that could be more formally approved by their countries next week in Oslo, but the Ottawa meeting produced so little that Canadian Environment Minister David Anderson said an Oslo follow-up would be "unlikely." The report, released today, found that the NRC misled Rep. Edward J. Markey (D-Mass) regarding the release of an internal commission policy paper to the Nuclear Energy Institute (NEI). The NRC shared the paper, which addressed the NRC's policy governing generic communications, with the NEI and provided the institute with an exclusive opportunity to review and comment on it. The NRC told Markey's office that the draft was simultaneously made available to the public when in fact it wasn't, the report said. In fact, the NRC never solicited public comment on the document. "The Nuclear Regulatory Commission has abdicated its regulatory responsibil- ity to the nuclear industry and excluded the public from the process," said Wenonah Hauter, director of Public Citizen's Critical Mass Energy Project. "The NRC is supposed to be regulating the nuclear industry, not the other way around." Because these policy papers are the primary decision-making tool of the commission, Public Citizen believes that it is improper for the nuclear industry to have an exclusive opportunity to review and alter their contents. Allowing NEI to review and alter NRC's policy papers is in direct conflict with at least two of the NRC's "principles of good regulation," which include independence and openness, Hauter said. At the very least, the NRC should withdraw the document unless and until all interested parties have an opportunity to review it and provide comment, she said. "The NRC gives little more than lip service to the notion of public participation while simultaneously leaking internal commission documents to the nuclear industry and then proceeds to lie about it to Congress," said James Riccio, senior analyst with Public Citizen's Critical Mass Energy Project. "It is no wonder that the NRC has garnered the disdain and mistrust of the public it is supposed to represent and protect." The IG report, entitled "Misleading NRC Response to a Congressional Request for Information Concerning Circumstances Surrounding the Release of Draft SECY - 99-143," states that "information contained in a July 19, 1999, letter signed by Chairman Dicus to Congressman Markey was inaccurate and misleading." The letter from interim NRC Chairman Greta Dicus "inaccurately depicts that between April 7 and 22, 1999, the NRC staff simultaneously provided the draft SECY to NEI and the public." The report determined that the inaccurate information given Markey's office was "built on erroneous information" supplied by someone involved in the development of the draft document. The information was not verified before being sent to Markey's office. Further, more accurate information was available but was not given to Markey. The report determined that NRC staff "did not exercise due care" in ensuring the accuracy of the information. "Unfortunately, the NRC is neither independent nor open, and neither objective nor unbiased," Riccio said.
